Terms of Service

1. Acceptance of Terms and Conditions

Welcome to WordWise. These Terms of Service ("Terms," "Agreement," or "Terms of Service") constitute a legally binding agreement between you ("User," "you," or "your") and AppsLuna ("Company," "we," "us," or "our") governing your access to and use of the WordWise mobile application, including any content, functionality, and services offered on or through the application (collectively, the "Service" or "App").

By downloading, installing, accessing, or using the WordWise application, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms of Service or the Privacy Policy, you must not access or use the Service. Your continued use of the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes.

We reserve the right, at our sole discretion, to modify, amend, or replace these Terms of Service at any time. It is your responsibility to review these Terms of Service periodically for changes. Material changes will be notified through appropriate channels, including but not limited to in-app notifications, email communications, or prominent notices on our website.

2. Eligibility and Account Requirements

The Service is intended solely for users who are thirteen (13) years of age or older. By accessing or using the Service, you represent and warrant that you are at least thirteen (13) years of age and have the legal capacity to enter into this Agreement. If you are between the ages of thirteen (13) and eighteen (18), you represent that your parent or legal guardian has reviewed and agrees to these Terms on your behalf.

If you are accessing the Service on behalf of a company, organization, or other legal entity, you represent and warrant that you have the authority to bind such entity to these Terms, in which case the terms "you" and "your" shall refer to such entity. If you do not have such authority, or if you do not agree with these Terms, you must not accept these Terms and may not use the Service.

We reserve the right to refuse access to the Service, terminate accounts, remove or edit content, or cancel orders at our sole discretion, without prior notice and without liability to you. Such actions may be taken for any reason, including but not limited to violation of these Terms, fraudulent activity, or behavior that we deem harmful to other users or the integrity of the Service.

3. Description of Service and Features

WordWise is a comprehensive vocabulary learning application designed to facilitate language acquisition through personalized, daily vocabulary instruction. The Service employs advanced artificial intelligence technologies and pedagogical methodologies to deliver customized educational content tailored to each user's learning objectives, proficiency level, and personal interests.

The core features and functionalities of the Service include, but are not limited to:

• Personalized daily vocabulary words generated through sophisticated machine learning algorithms that analyze user preferences, learning patterns, and educational goals to optimize the learning experience;
• Comprehensive pronunciation guides including phonetic transcriptions, audio pronunciations utilizing text-to-speech technology, and detailed articulation instructions;
• Contextual example sentences demonstrating proper usage, grammatical construction, and idiomatic expressions in authentic communication scenarios;
• Scientifically-designed spaced repetition review systems based on cognitive science research and memory retention principles to maximize long-term vocabulary retention;
• Gamification elements including experience points, achievement systems, daily streaks, and progress tracking to enhance user engagement and motivation;
• Multi-language support enabling users to learn vocabulary across multiple target languages from a single account;
• Detailed etymological information, cultural context, and linguistic curiosities to deepen understanding and appreciation of vocabulary;
• Customizable notification systems to support consistent learning habits and daily engagement;
• Progress analytics and performance metrics to track learning outcomes and identify areas for improvement.

The Service is provided on an "as is" and "as available" basis. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, including the availability of any feature, database, or content, without prior notice or liability. We may also impose limits on certain features and services or restrict your access to parts or all of the Service without notice or liability.

4. User Accounts and Authentication

WordWise utilizes a streamlined authentication system designed to minimize friction while maintaining security. Upon initial use of the application, an anonymous account identifier is automatically generated and associated with your device. This identifier enables the synchronization of your learning progress, preferences, and achievements across sessions without requiring traditional account creation procedures involving email addresses or passwords.

You are solely responsible for maintaining the confidentiality and security of your device and any credentials associated with your account. You agree to accept responsibility for all activities that occur under your account or on your device. You must immediately notify us of any unauthorized use of your account or any other breach of security of which you become aware.

You acknowledge and understand that if you uninstall the application, perform a factory reset on your device, or otherwise remove the application data without first ensuring proper backup or account recovery mechanisms are in place, your learning progress, historical data, and accumulated achievements may be permanently and irretrievably lost. AppsLuna shall not be held liable for any such data loss resulting from user actions or device modifications.

5. Premium Subscription Services

WordWise may offer premium subscription plans ("Premium Services") that provide access to enhanced features, additional content, and exclusive functionalities beyond the basic free tier. The specific features, pricing, and terms of Premium Services will be clearly communicated at the point of purchase and may vary by region, promotional period, or user segment.

If you choose to purchase a Premium subscription, you acknowledge and agree to the following terms:

• Payment will be charged to your designated payment method through the Apple App Store, Google Play Store, or other authorized payment processors at the time of purchase confirmation;
• Subscriptions automatically renew for successive periods of equal duration unless cancelled at least twenty-four (24) hours before the end of the current billing period;
• Renewal charges will be applied to your designated payment method within twenty-four (24) hours prior to the end of the current subscription period at the then-current subscription rate;
• You may manage your subscription and disable automatic renewal at any time through your device's app store account settings. Instructions for managing subscriptions vary by platform and are available in the respective app store help documentation;
• Refunds for subscription payments are subject to the refund policies of the applicable app store platform (Apple App Store or Google Play Store) and may be requested through the respective platform's refund request procedures;
• We reserve the right to modify subscription pricing upon reasonable notice. Price changes will not affect the current billing period but will apply to subsequent renewal periods;
• Free trial periods, if offered, are limited to one trial per user account. Attempting to obtain multiple free trials through the creation of multiple accounts or other means constitutes a violation of these Terms;
• Premium features and content are provided for personal, non-commercial use only and may not be shared, transferred, or sublicensed to other parties.

6. Artificial Intelligence Generated Content

WordWise leverages advanced artificial intelligence and machine learning technologies to generate personalized vocabulary content, including but not limited to word selections, definitions, example sentences, pronunciation guides, etymological information, and cultural context. This AI-generated content is designed to enhance your learning experience by providing relevant, contextually appropriate, and pedagogically sound educational materials.

You acknowledge and understand that:

• AI-generated content, while carefully designed and validated, may occasionally contain inaccuracies, errors, or inconsistencies. We continuously work to improve content quality but cannot guarantee absolute accuracy in all cases;
• The Service is intended as a supplementary educational tool and should not be considered a substitute for formal language instruction, professional translation services, or authoritative linguistic reference materials;
• Learning outcomes, vocabulary retention, and language proficiency improvements vary significantly among users based on factors including but not limited to learning consistency, prior language exposure, individual cognitive abilities, and engagement with the material;
• We do not guarantee specific learning outcomes, fluency levels, test scores, or professional certifications as a result of using the Service;
• AI-generated content is provided for educational and informational purposes only and should not be relied upon for professional, legal, medical, or other specialized applications where accuracy is critical.

7. User Conduct and Acceptable Use Policy

As a condition of your use of the Service, you agree to comply with all applicable local, state, national, and international laws, statutes, ordinances, and regulations. You further agree that you will not engage in any activity that interferes with or disrupts the Service or the servers, networks, and infrastructure connected to the Service.

You expressly agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws or regulations;
• Attempt to gain unauthorized access to any portion of the Service, other user accounts, computer systems, or networks connected to the Service through hacking, password mining, or any other means;
• Use any robot, spider, scraper, or other automated means to access the Service for any purpose without our express written permission;
• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, underlying algorithms, or structure of the Service or any component thereof;
• Modify, adapt, translate, or create derivative works based on the Service or any part thereof;
• Remove, alter, or obscure any copyright, trademark, or other proprietary rights notices from the Service;
• Use the Service to transmit any malicious code, viruses, worms, defects, Trojan horses, or any items of a destructive nature;
• Interfere with or disrupt the integrity or performance of the Service or the data contained therein;
• Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity;
• Collect or harvest any personally identifiable information from other users of the Service;
• Use the Service to send unsolicited communications, promotions, advertisements, or spam;
• Create multiple accounts to abuse free features, circumvent usage limitations, or manipulate gamification systems;
• Share, distribute, or otherwise make available any content from the Service without proper authorization;
• Use the Service in any manner that could damage, disable, overburden, or impair the Service or interfere with any other party's use of the Service.

8. Intellectual Property Rights

The Service and all contents, features, and functionality thereof, including but not limited to all information, software, code, algorithms, text, displays, images, video, audio, graphics, photographs, illustrations, artwork, icons, logos, trademarks, service marks, trade dress, user interface designs, and the arrangement thereof (collectively, "Content"), are owned by AppsLuna, its licensors, or other providers of such material and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

The AI-generated educational content provided through the Service, including vocabulary words, definitions, example sentences, and related materials, is generated specifically for your personal learning use. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use such content solely for personal, non-commercial educational purposes in accordance with these Terms.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the Content except as expressly permitted by these Terms or with our prior written consent. You may not use any illustrations, photographs, video or audio sequences, or any graphics separately from the accompanying text.

The WordWise name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of AppsLuna or its affiliates. You may not use such marks without our prior written permission. All other names, logos, product and service names, designs, and slogans on the Service are the trademarks of their respective owners.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

APPSLUNA, ITS SUBSIDIARIES, AFFILIATES, LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, AND DIRECTORS DO NOT WARRANT THAT: (A) THE SERVICE WILL FUNCTION UNINTERRUPTED, SECURE, OR AVAILABLE AT ANY PARTICULAR TIME OR LOCATION; (B) ANY ERRORS OR DEFECTS WILL BE CORRECTED; (C) THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; (D) THE RESULTS OF USING THE SERVICE WILL MEET YOUR REQUIREMENTS; OR (E) THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY CONTENT PROVIDED THROUGH THE SERVICE.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL APPSLUNA, ITS AFFILIATES, SUBSIDIARIES, LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES (EVEN IF APPSLUNA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), ARISING OUT OF OR IN CONNECTION WITH: (A) YOUR USE OR INABILITY TO USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (C) ANY CONTENT OBTAINED FROM THE SERVICE; (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT; (E) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICE; OR (F) ANY OTHER MATTER RELATING TO THE SERVICE.

IN NO EVENT SHALL THE AGGREGATE LIABILITY OF APPSLUNA AND ITS AFFILIATES, SUBSIDIARIES, LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, AND DIRECTORS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICE EXCEED THE GREATER OF: (A) THE AMOUNTS YOU HAVE PAID TO APPSLUNA IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR (B) ONE HUNDRED UNITED STATES DOLLARS (USD $100.00).

THE LIMITATIONS OF LIABILITY SET FORTH IN THIS SECTION SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION AND SHALL SURVIVE THE TERMINATION OR EXPIRATION OF THESE TERMS AND YOUR USE OF THE SERVICE.

11. Indemnification

You agree to defend, indemnify, and hold harmless AppsLuna, its parent companies, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from: (a) your use of and access to the Service; (b) your violation of any term of these Terms; (c) your violation of any third-party right, including without limitation any copyright, trademark, property, or privacy right; (d) any claim that your use of the Service caused damage to a third party; or (e) any content you submit, post, or transmit through the Service.

This defense and indemnification obligation will survive the termination of these Terms and your use of the Service. AppsLuna reserves the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate fully with AppsLuna in asserting any available defenses.

12. Termination

These Terms are effective until terminated by either party. You may terminate your agreement with these Terms at any time by discontinuing use of the Service and, if applicable, deleting the application from your device.

We may, in our sole discretion and without prior notice or liability, immediately terminate or suspend your access to all or any portion of the Service for any reason whatsoever, including without limitation: (a) breach or violation of these Terms; (b) a request by law enforcement or other government authorities; (c) discontinuation or material modification of the Service; (d) unexpected technical or security issues; (e) extended periods of inactivity; (f) engagement by you in fraudulent or illegal activities; or (g) nonpayment of any fees owed by you in connection with the Service.

Upon termination of your account or access to the Service: (a) your right to use the Service will immediately cease; (b) any licenses granted to you under these Terms will automatically terminate; (c) we may, but are not obligated to, delete your account information and content; and (d) provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnification obligations, and limitations of liability.

13. Governing Law and Dispute Resolution

These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with applicable laws, without regard to principles of conflict of laws that would result in the application of the laws of any other jurisdiction.

Any dispute arising out of or relating to these Terms, including the validity, invalidity, breach, or termination thereof, shall be resolved through binding arbitration administered in accordance with the arbitration rules of the applicable arbitration institution then in effect. The arbitration shall be conducted by a single arbitrator, and the decision of the arbitrator shall be final and binding upon the parties. Judgment upon the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.

Notwithstanding the foregoing, you agree that AppsLuna shall be entitled to seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of AppsLuna's intellectual property rights, data, or confidential information.

You agree that any arbitration or court proceeding shall be conducted on an individual basis only, and not as a class action, collective action, or representative action. You expressly waive any right to participate in any class action, collective action, or representative action against AppsLuna.

14. General Provisions

Entire Agreement: These Terms, together with the Privacy Policy and any other legal notices or policies published by us on the Service, constitute the entire agreement between you and AppsLuna concerning your use of the Service and supersede all prior or contemporaneous communications, proposals, and agreements, whether electronic, oral, or written, between you and AppsLuna with respect to the Service.

Severability: If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity, illegality, or unenforceability shall not affect the remaining provisions of these Terms, which shall remain in full force and effect. The invalid, illegal, or unenforceable provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable while preserving its original intent.

Waiver: The failure of AppsLuna to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of AppsLuna.

Assignment: You may not assign or transfer these Terms or your rights hereunder, in whole or in part, by operation of law or otherwise, without our prior written consent. We may assign these Terms at any time without notice to you. Subject to the foregoing, these Terms will be binding upon and inure to the benefit of the parties and their respective successors and permitted assigns.

Force Majeure: AppsLuna shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, epidemics, pandemics, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

Notices: Any notices or other communications provided by AppsLuna under these Terms will be given by posting to the Service or, at our option, by email to the email address associated with your account, if any. You consent to receive communications from us electronically. It is your responsibility to ensure that any email address associated with your account is current and accurate.

Headings: The section headings in these Terms are for convenience only and have no legal or contractual effect.

Privacy Policy

AppsLuna ("Company," "we," "us," or "our") is committed to protecting the privacy and security of personal information entrusted to us by users of the WordWise mobile application ("Service" or "App"). This Privacy Policy describes our practices regarding the collection, use, storage, sharing, and protection of personal information obtained through the Service.

This Privacy Policy applies to all users of the Service worldwide and is designed to comply with applicable data protection laws and regulations, including but not limited to the General Data Protection Regulation (GDPR) for users in the European Economic Area, the California Consumer Privacy Act (CCPA) for users in California, the Lei Geral de Proteção de Dados (LGPD) for users in Brazil, and other applicable privacy laws.

By accessing or using the Service, you acknowledge that you have read, understood, and agree to the collection, use, and disclosure of your information as described in this Privacy Policy. If you do not agree with this Privacy Policy, please do not access or use the Service.

When you download, install, and use the WordWise application, certain information is collected automatically to enable the functionality of the Service and improve your user experience. This automatically collected information includes:
